CBAM: EU Commission Publishes Implementing Acts

23 December 2025 – Just before the end of the year, the Commission has published the majority of the final implementing acts for the launch of the CBAM CO2 tax on 1 January 2026. Nickel prices have risen again. The Stainless Espresso team wishes you a Merry Christmas and a Happy New Year.

CBAM: EU Commission Publishes Implementing Acts

Just before the end of the year, the Commission published the majority of the final implementing regulations for the start of the CBAM CO2 tax on 1 January 2026.

However, important documents are still missing-such as the final regulation for the default values, which runs to more than 1,300 pages, or the rules on how CO2 costs already paid in third countries are to be taken into account in the CBAM calculation.

Commission Under Heavy Criticism Over CBAM Introduction

In this context, the Commission is facing heavy criticism for publishing key documents, legal frameworks, and calculation methodologies only at the very last minute before the introduction of a new tax that entails costs amounting to billions of euros for European companies.

In addition, the Commission caused significant confusion among affected companies by allowing “leaks” of CBAM draft texts at different stages of development to circulate.

Nickel Prices Rise Again

Nickel prices on the SHFE commodity exchange rose again today by around 3.8%. On the LME, nickel was trading about 1.3% higher shortly after the start of trading. The background to the recent price increases is the Indonesian government’s plans to reduce nickel ore mining volumes in 2026.

Whether this will actually be implemented remains unclear. As early as the end of 2024, the Indonesian government had already publicly considered reducing nickel mining quotas-but was ultimately unable to implement the plan.
