Riegel, 14 July 2021 – The Gerber Group, with its CEO Thorsten Gerber, has in recent days expressed its grave concern to the European Commission and the Directorate-General Trade that serious legal errors have been made in the Expiry review of the anti-dumping measures applicable to imports of stainless steel cold-rolled flat products originating in the People’s Republic of China and Taiwan. We reported already about a possible error.

Do errors in Expiry Review R722 violate applicable EU law?
“In our opinion, these errors violate applicable EU law, ” said Thorsten Gerber. Furthermore, Mr. Gerber stated, “The proposed EC anti-dumping extension against Taiwan and China also inflicts further serious damage to the steel-consuming EU downstream industry, should it be implemented as it is currently before us.”
Already errors in EU Safeguard extension
Gerber Group had already pointed out a weighty calculation error in the EU’s first notification to the WTO on the Safeguard extension 2021. This then had to be corrected by the EU and massively watered down the justification for an extension of Safeguard. A few days ago, another error had to be admitted and corrected by the European Commission – again a calculation error.
Gerber Group expresses concern about the anti-dumping development
“It is unacceptable that possible legal errors in the Expiry Review are simply passed over by DG Trade. Therefore, we have informed Prime Minister Janez Janša and the Republic of Slovenia, as acting EU Council President and EC President Ursula von der Leyen, about this anti-dumping case,” states Thorsten Gerber and concludes: “We have expressed our great concern to Prime Minister Janez Janša and EC President Ursula von der Leyen that such a breach of the law, triggered by some lobbyists, could lead to. Further damage to the European processing industry must be averted at all costs.”
